Food Ordering and Delivery Terms and Conditions

  1. These terms and conditions governing food orders placed through taurakalnis.lt together with the delivery service (hereinafter referred to as the “Food Delivery Service”) (hereinafter referred to as the “Terms and Conditions”) constitute a legally binding document for the Buyer and the Seller. They set out the rights and obligations of the Buyer and the Seller, as well as the conditions governing food ordering, delivery and payment. By ticking the box “I have read and agree to the Terms and Conditions” when placing an order, the Buyer confirms that they have read, understood and agreed to comply with these Terms and Conditions. The Terms and Conditions apply to food orders placed through taurakalnis.lt.
  2. The Food Delivery Service is provided by UAB Taurakalnis (legal entity registration number 121099182; registered address: Tauro St. 5-1, Vilnius, Lithuania).
  3. The final price of the services is displayed after the Buyer confirms their shopping cart and before payment is made.
  4. The Seller may, at its discretion, offer various promotions on taurakalnis.lt.
  5. Food orders may be paid for using the following methods:5.1. bank transfer based on an invoice issued by the Seller;

    5.2. online banking through Paysera.

  6. If a Buyer who has paid for a food order through online banking using the Paysera payment system fails to receive the order through their own fault, or if the Buyer breaches these Terms and Conditions, the amount paid will be refunded after deducting any losses incurred by the Seller.
  7. The Buyer is fully responsible for the accuracy of the information submitted and confirmed when placing a food order. The Buyer is also responsible for ensuring that the order can be accepted and handed over. The Seller shall not be liable for any consequences and shall be entitled to claim compensation for losses incurred if the Buyer provides inaccurate information, confirms incorrect information, or fails to accept the order at the specified delivery location and time—that is, if the order cannot be handed over due to the Buyer’s failure to comply properly with these Terms and Conditions.
  8. The Buyer may place a food order only in their own interests or in the interests of another person who has instructed or authorised them to do so. The Buyer must provide only their own personal data or the data of persons who have authorised them to provide such information.
  9. By providing information and data to the Seller, the Buyer confirms that they are the owner or data subject of the personal data provided, or that they are otherwise legally entitled to provide such data.
  10. When providing any information or data, the Buyer must ensure—and is responsible for ensuring—that all data and information provided, including but not limited to personal data, are correct, accurate and complete.
  11. The Seller undertakes to respect the Buyer’s privacy and to process the Buyer’s personal data only in accordance with these Terms and Conditions, the Privacy Policy published on taurakalnis.lt, and the applicable laws of the Republic of Lithuania.
  12. Photographs of dishes displayed on taurakalnis.lt are provided for informational and illustrative purposes only. The actual appearance of the food may differ due to the screen resolution or colour settings of the device used to place the order, as well as the specific packaging, containers and seasonal decorative elements used. The Buyer understands that the appearance of the food may differ slightly from the photographs. The order packaging may also vary slightly.
  13. The Buyer shall not be entitled to make any claims against the Seller, and the Seller shall not be liable to the Buyer:

13.1. if the Buyer provides an incorrect delivery address;

13.2. if the Buyer provides an incorrect telephone number;

13.3. if the Buyer provides an incorrect preferred delivery time;

13.4. if the Buyer fails to accept the order through no fault of the Seller—for example, by failing to open the door or answer the telephone;

13.5. if the Buyer fails or refuses to pay the Seller for the food ordered without objective grounds for doing so.

  1. The Seller shall be entitled to withhold the food order from the Buyer if any of the circumstances specified in Clauses 13.1–13.5 apply.
  2. The Seller shall be entitled to amend or supplement these Terms and Conditions in the event of changes to the laws of the Republic of Lithuania or where other objective grounds exist. The updated version of the Terms and Conditions will be presented to the Buyer when placing a new order and ticking the box “I have read and agree to the Terms and Conditions”. The version of the Terms and Conditions in force at the time the order was placed shall apply to that order.
  3. Any disputes arising from the implementation of these Terms and Conditions shall be resolved through negotiation. If an agreement cannot be reached, the dispute shall be resolved in accordance with the laws of the Republic of Lithuania.
  4. The Buyer may submit requests or complaints concerning food purchased or services provided through the Seller’s online store at taurakalnis.lt via the European Commission’s online dispute resolution platform: http://ec.europa.eu/odr/.
  5. Consumer disputes are resolved out of court by the State Consumer Rights Protection Authority, registered office: Vilniaus St. 25, LT-01402 Vilnius, Lithuania; www.vvtat.lt.
